Another recent case resolved – I was supposed to be on trial today, actually. It was a case from a liability standpoint – was pretty clear. The other driver had crossed over into our lane and caused a collision with us in our lane. My client struck his knee and had to undergo a knee surgery, and then he had to undergo a further repair. The problem with the case wasn’t so much the impact and the surgery, but it’s that he didn’t let him affect it, wherein he didn’t miss time from work except for the recovery from the surgeries.

His own doctor was somebody who does a lot of work for the defense insurance companies, so he’s called by them to give opinions – not in our case because he was our treating doctor. He’s somebody who is extremely conservative and actually had been called upon many times by the defense to give opinions in other cases. In his medical reports for us, he wasn’t really documenting as clearly as we had hoped about our complaints, some problems we were having functionally, but that doctor did focus on we had full range of motion and full strength, which we did have. The issue was the inability to kneel, which the doctor just refused to document adequately throughout the treatment.

Despite that, I was able to get a really great result, a multiple six-figure result. In the last week or two we wrapped things up. Based upon our pushing it forward, getting our expert witness disclosures out there, and really being ready for trial, despite the fact that we had some shortcomings, or some shortfalls I would say, in our own medical record documentation. The client would have presented it very well, even though the doctor wouldn’t have given us really everything I think he probably should have regarding the nature and extent of the harms that were caused because of this impact.
